A number of reports and documents may further your understanding of the CINMS management plan review process. A brief description of, and links to each item are provided below.

2009 FINAL MANAGEMENT PLAN and FINAL RULE (REGULATIONS), & 2008 (FEIS)

The Final Management Plan (FMP) contains information about the Sanctuary's environment, staffing and administration, regulations and boundary, operational and programmatic costs, priority management issues and the actions proposed to address them, and performance measures. It is accompanied by a Final Environmental Impact Statement (FEIS; released November 25, 2008), which contains detailed information on the greater sanctuary region, presents a range of alternatives for modified and new sanctuary regulations, provides environmental and socioeconomic impact analyses of those regulatory alternatives, and provides responses to public comments previously submitted on the Draft Management Plan (DMP), Draft Environmental Impact Statement (DEIS) and Supplemental DEIS. These two documents are bundled together in two volumes: the FMP is Volume I, and the FEIS is Volume II. Of the alternatives analyzed in the FEIS, NOAA has decided to implement the proposed action alternative. The Final Rule presents the resulting new Sanctuary regulations (which take effect after 45 days of continuous session of Congress), and also includes the responses to public comments. Please check back for a Federal Register notice announcing the effective date of the new Sanctuary regulations.

SDEIS and Proposed Rule

The Supplemental Draft Environmental Impact Statement (SDEIS) provides information to supplement and where indicated to replace information contained in the May 2006 DEIS. The May 2006 DEIS included a range of alternatives consisting of the proposed action, alternative 1, and the no-action alternative. After receiving comments on the DEIS, NOAA determined that the original range of alternatives needed to be modified to better address potential impacts of sewage and graywater discharges from large vessels (300 gross registered tons or more). Thus, the SDEIS modifies the range of regulatory changes under consideration and discusses the potential environmental consequences of a revised discharge regulation. The proposed revisions to the discharge regulation are now incorporated into the original proposed action and constitute NOAA's “revised proposed action.” NOAA is not taking final action with the SDEIS, but rather is analyzing and putting forth for public review and comment a revision to its discharge regulation proposed in the DEIS. Details of the revised discharge regulation are provided in a proposed rule.

Based on comments received during the 2006 public comment period for the DMP/DEIS, and the 2008 public comment period for the SDEIS, the Sanctuary has prepared a Final Management Plan and Final Environmental Impact Statement (see above).

2006 Draft Management Plan / DEIS

The Draft Management Plan contains information about the sanctuary’s environment and resources, staffing and administration, regulations and boundaries, priority management issues and the actions proposed to address them, and performance measures.  It is supported by a Draft Environmental Impact Statement (DEIS), which contains detailed information on the greater sanctuary region, presents a range of alternatives for modified and new sanctuary regulations, and provides environmental and socioeconomic impact analyses of those regulatory alternatives.  These two documents are bundled together in two volumes: the Draft Management Plan is Volume I, and the DEIS is Volume II.

The public comment period for the DMP/DEIS closed on July 21, 2006.  Based on comments received during the public comment period, in March 2008, the Sanctuary released a Supplemental (DEIS) (see above). Based on comments received during the 2006 public comment period for the DMP/DEIS, and the 2008 public comment period for the SDEIS, the Sanctuary has prepared a Final Management Plan and Final Environmental Impact Statement (see above).

2006 DMP/DEIS Federal Register Notice & Proposed Rule

On May 19th, 2006 a Federal Register Notice was published that announced the availability of the Draft Management Plan/Draft Environmental Impact Statement and contained the "Proposed Rule" concerning proposed regulation and designation document changes.

NCCOS Biogeographic Study
Sanctuary boundary redefinition was raised during 1999 public scoping meetings as an issue to be considered in the CINMS management plan review process.

In 2002 the National Oceanic and Atmospheric Administration (NOAA) and National Marine Sanctuary Program determined that a rigorous analysis of boundary alternatives would require a biogeographic study of the Channel Islands region. NOAA’s National Centers for Coastal Ocean Science (NCCOS) prepared this biogeographic study from 2003 - 2005. In the fall of 1999 CINMS contracted the University of California, Santa Barbara's Ocean and Coastal Policy Center to recommend a management plan review study area (including the existing Sanctuary).
The Ocean and Coastal Policy Center produced their findings on January 14, 2000, entitled, "A Recommended Study Area for the CINMS Management Planning Process: Ecological Linkages in the Marine Ecology from Point Sal to Point Mugu." Click here for a map of the study area.

Following the 1980 designation of CINMS, the Sanctuary published its Management Plan in 1983. This plan describes the Sanctuary, outlines Sanctuary goals and program areas, presents the Sanctuary's administrative framework, and provides guidelines for actions that meet Sanctuary objectives.

Pursuant to Section 304(a)(4) of the National Marine Sanctuaries Act, a Sanctuary’s terms of designation set forth the geographic area included within the Sanctuary; the characteristics of the area that give it conservation, recreational, ecological, historical, research, educational or esthetic value; and the types of activities that will be subject to regulation by the Secretary of Commerce to protect those characteristics. The terms of designation are published in the Federal Register. The CINMS terms of designation were published in the Federal Register (Vol. 45 No. 193) on October 2, 1980.


National Marine Sanctuaries Act


The National Marine Sanctuaries Act (NMSA) of 1972 (16 U.S.C. §1431 et. seq.) authorizes the Secretary of Commerce to designate as national marine sanctuaries areas of the marine environment or Great Lakes with special national significance due to their conservation, recreational, ecological, historical, scientific, cultural, archeological, educational, or aesthetic qualities. Additionally, the NMSA established the National Marine Sanctuary Program as the Federal program charged with managing national marine sanctuaries.
